PREA (Prison Rape Elimination Act)

SWMCCC/DADC is committed to the safety of all inmates, staff, and the community of SW ND.

SWMCCC/DADC Mission Statement: The staff of SWMCCC/DADC commits to provide a rehabilitative environment that is physically and emotionally safe, being mindful to the victims and the public. Our mission is to facilitate successful adaptations of offenders into society. This is accomplished through the self-empowerment of staff and offenders to grow emotionally, socially, educationally, spiritually, and culturally.

SWMCCC/DADC is further committed to implementing the Prison Rape Elimination Act (PREA) Standards regarding the prevention, detection, and coordinated response to sexual assault, sexual abuse, and sexual harassment in correctional facilities.

The Prison Rape Elimination Act, or PREA, was signed into law by President Bush on September 4, 2003. The final standards to implement PREA went in to effect on August 20, 2012.

If you have knowledge about an inmate who may have experienced sexual abuse, or sexual harassment at any time while incarcerated at SWMCCC/DADC, please make a third-party report. Simply write, call, or fax Rachelle Juntunen the SWMCCC/DADC Operations Administrator OR Lenore Witte the SWMCCC PREA Coordinator OR Adam Jangula the DADC PREA Compliance Manager at the address/phone/fax numbers listed below. You may assist a SWMCCC/DADC inmate in filing a grievance regarding sexual abuse, and sexual harassment upon the inmate’s request.

Third-party reports may also be made to the Dickinson Police Department at (701)-456-7759.

Inmates are encouraged to verbally report to correction officers, medical or mental health staff, SWMCCC/DADC administration, probation officers, volunteers, attorneys, counselors, case managers, family and friends.

Inmates may also make a report by writing memos, and may assist each other in filing grievances including emergency grievances. Emergency intercoms are in inmate housing units.

Further, inmates may report sexual abuse and sexual harassment by calling the Dickinson Police Department nonemergency number or the Domestic Violence Rape Crisis Center free of charge on any inmate phone. An inmate may request to remain anonymous. Specific directions to make these calls are on PREA posters, prominently displayed by inmate phones in all housing areas.

A report regarding sexual abuse, or sexual harassment may be made at anytime, while in custody, or after release; however, inmates may be held accountable for false reports.

Every reported incident of sexual abuse, or sexual harassment will be aggressively investigated either criminally by the Dickinson Police Department, or administratively by qualified, trained PREA investigators.

Employees, volunteers, contractors, and inmates will all be held accountable to established PREA standards and are provided training and information regarding their rights and responsibilities under this law.

All sexual and romantic activity between staff, volunteers, contractors, and inmates is prohibited, and against the law. Consensual sexual activity between inmates is prohibited and is a serious facility violation.

No matter why an individual is incarcerated, sexual assault, sexual abuse, and sexual harassment are NEVER PART OF THE PENALTY! If an inmate is sexually abused while incarcerated at SWMCCC/DADC, they have a right to medical and mental health care related to the abuse at no cost to them.

SWMCCC/DADC maintains a ZERO TOLERANCE culture regarding sexual abuse, and sexual harassment. One instance is one too many!
